By placing an order in the online shop at www.aurearegina.ee, the Customer accepts all the General Terms and Conditions of the online shop of Aurea Regina OÜ.
1. Validity of the sales agreement, information on the goods and prices
These General Terms and Conditions apply to all legal relationships arising from the purchase of products by a person (hereinafter ‘Customer’) via the shopping environment at www.aurearegina.ee (hereinafter ‘Aurea Regina’ or ‘online shop’).
The prices of the goods sold in the online shop are marked next to the product in EUR and include VAT in accordance with the law of the Republic of Estonia.
A fee for the delivery of the goods is added to the price. The delivery fee depends on the chosen delivery method. The delivery fee options are displayed when you are placing an order.
Information about the goods is provided in the online shop directly next to the goods.
In addition to these General Terms and Conditions, the legal relationships arising from the purchase of products via the online shop of Aurea Regina OÜ are regulated by the current legislation of the Republic of Estonia.
Aurea Regina OÜ is entitled to amend and modify these General Terms and Conditions and the price list due to the development of the E-Coin Shop and in the interests of better and safer use of the online shop. Amendments and modifications to the General Terms and Conditions and the price list will be announced via the website at www.aurearegina.ee. Amendments and modifications to the General Terms and Conditions and the price list shall enter into force upon publication of the respective amendment or modification of the website at www.aurearegina.ee. If the Customer submits an order before the amendments to the General Terms and Conditions enter into force, the General Terms and Conditions valid at the time of the Customer’s transfer of the order shall apply to the legal relationship between the Customer and Aurea Regina OÜ, unless otherwise provided by law or these General Terms and Conditions.
To order the goods, you must add the desired products to the shopping cart. To place an order, please fill in the required data fields and select the appropriate method of product delivery. The screen will then display the amount of the fee (EUR), which can be paid by using a bank link, debit or credit card or other payment solution.
The agreement enters into force upon receipt of the amount due in the current account of Aurea Regina OÜ. Payment by a bank link and bank card will reach the seller’s current account in a few moments. Payment takes place outside the online shop in a secure environment – when paying with a bank link in the secure environment of the respective bank and when paying with a credit card in the secure environment of EveryPay AS. The seller does not have access to the Customer’s bank and credit card details. When starting a payment from another bank, the payment must be received according to the settlement speed between the banks, but not later than by 12.00 on the next banking day. If the payment is not received within the time specified in the General Terms and Conditions or is received later, the seller has the right to cancel the order. In this case, the late payment will be returned to the buyer’s bank account as soon as possible, but no later than within 2 (two) banking days.
If the ordered goods cannot be delivered due to the fact that the goods are out of stock or for any other reason, the buyer will be notified as soon as possible and the money paid (including delivery costs) will be refunded immediately, but no later than within 5 days of sending the notice.
When placing an order, an order confirmation is automatically sent to the Customer together with the General Terms and Conditions of the sales agreement, which the buyer can save and reproduce.
The order enters into force when the goods have been paid for and the payment reaches the account of Aurea Regina OÜ via the bank link and payment card at the moment of placing the order. When placing an order, it is possible to choose whether the order is delivered by choosing a suitable delivery method (Omniva courier service, Omniva parcel machine) or issued from the Aurea Regina OÜ shop at Vana-Viru tn 5, in Tallinn, during its opening hours Mon–Fri from 10–17; Sat from 11–16.
Shipping costs for the goods are borne by the buyer and the corresponding price information is displayed when ordering. For delivery by post, it is mandatory to indicate the contact phone number so that the transport service provider can send a notice regarding the arrival of the parcel. Orders placed before 16.00 on a working day will be posted on the same day. Orders placed on weekends or public holidays will be delivered the next business day.
Please verify the correctness of the contact information provided when ordering, to avoid delays and misunderstandings in the delivery of products. Aurea Regina OÜ and the courier company are not responsible for delays in the delivery of products and misunderstandings if the delay or misunderstanding is due to the inaccuracy of the information provided by the Customer when placing the order.
The price of the Omniva courier service and Omniva parcel machine is valid only in case of domestic delivery within Estonia. The price list of international standard mail is valid for delivery abroad.
NB: Prices in the shop and in the online shop may differ.
3. Right of withdrawal and returning of products
Aurea Regina OÜ reserves the right to cancel the order if, due to extraordinary reasons, it is not possible to sell the products, in which case all of the money paid will immediately be refunded to the Customer.
Possible reasons for order cancellation:
- Computer malfunction or human error, due to which product prices or inventories do not correspond to reality.
- An emergency situation on the world market, which is causing the price of the precious metal to change significantly.
If it proves impossible to fulfil the order, Aurea Regina OÜ will contact the Customer to agree on new conditions or return all paid money to the Customer immediately.
The Customer has the right to cancel the order after paying for the products, but before delivery of the products, by sending a corresponding application to the email address of the seller’s online shop at email@example.com
After receiving the goods, you have the right to withdraw from the agreement concluded in the online shop within 14 days.
The right of withdrawal does not apply if the buyer is a legal person.
In order to exercise the 14-day right of return, the ordered goods may not be used in any other way than is necessary to verify the nature, characteristics, and functioning of the goods in the manner permitted for testing the goods in a physical shop. The purchased products will be returned to Aurea Regina OÜ by sending a corresponding withdrawal application to firstname.lastname@example.org with the order number, your current account details and address, or by calling Aurea Regina OÜ contact phone (+372)-601-8088. The buyer must return the goods within 14 days of submitting the application or provide proof that they have handed over the goods to the carrier within the aforementioned period.
Please note that precious metal products are not subject to return and exchange.
The Customer is obligated to open the product with sufficient care so as not to damage the packaging or the product. If the goods have been used for purposes other than those necessary to ascertain the nature, characteristics, and functioning of the goods or there are signs of use or wear, the online shop has the right to reduce the returnable amount corresponding to the decrease in the value of the goods.
The online shop may refuse to perform the refunds until the item that is the subject of the agreement has been returned or until the buyer has provided proof that they have returned the item, whichever is earlier.
The product to be returned must be complete (include all items included in the product package, such as certificates, etc.). If the product has been purchased as part of a campaign where another product has been added to the product, you must return the entire set (i.e. all products, including those received as gifts).
The online shop has the right to withdraw from the sales transaction and demand the goods back from the buyer if the price of the goods in the online shop is marked significantly below the market price of the goods due to a mistake.
NB: The costs of returning the goods must be borne by the buyer, unless the reason for the return is the fact that the item to be returned does not correspond to what was ordered (for example, an incorrect or defective product).
4. Right to submit a complaint
The online shop is liable for such non-compliance or defect of the goods sold to the buyer, which already existed at the time of delivery of the item and which becomes apparent within two years from the delivery of the goods to the buyer. During the first six months from the delivery of the item to the buyer, it is presumed that the defect already existed at the time of delivery of the item. It is the responsibility of the online shop to rebut the corresponding presumption. If the defect occurs, the buyer has the right to contact Aurea Regina OÜ directly at Vana-Viru 5 Tallinn 10111; via the online shop, by sending an email to email@example.com; or by phone (+372)-601-8088 within two months, at the latest.
The online shop is not responsible for defects that have occurred after the delivery of the goods to the buyer.
If the goods purchased from the online shop have defects for which the online shop is responsible, the online shop will repair or replace the defective goods. If the goods cannot be repaired or replaced, the online shop will return all fees associated with the sales agreement to the buyer.
In case of returning a non-compliant product, the amount paid for the product (including transport costs) will be transferred to the bank account indicated by the Customer no later than within 30 days of receiving a notice of withdrawal and request for product return.
Aurea Regina OÜ is not responsible for the following:
(1) Customer’s fault for product deterioration/damage (for example, it is prohibited to open a coin capsule). As a result of such an act, the sales guarantee is terminated and the seller is not liable for the presence of fingerprints or scratches due to the fact that the capsule has been opened or damaged as a result of falling or other mechanical damage. Any product damaged due to negligence will not be returned or exchanged.
At home, the Customer has the right to handle and use the ordered products only in the manner that they would be allowed to do so in the physical shop. For example, coin album tabs, in which coins or other objects are stored and traces of coins or other three-dimensional objects are clearly visible on the plastic, are also not subject to return and exchange. To determine the size of the coin pocket and make sure it fits, it is enough to place the object on top of the plastic pocket.
(2) For defects caused by improper use of the product.
(3) For normal physical wear and tear of the product during normal use.
5. Liability and force majeure
5.1. Aurea Regina OÜ is liable to the Customer and the Customer is liable to Aurea Regina OÜ for the damage caused to the other party by the violation of these General Terms and Conditions in the cases and to the extent provided by the current legislation of the Republic of Estonia.
5.2. Aurea Regina OÜ is not liable for damages caused to the Customer or for any delay in delivery of the product if the damage or delay in delivery of the product arises from circumstances which Aurea Regina OÜ could not influence and the arrival of which Aurea Regina OÜ did not or could not foresee (force majeure).
6. Direct marketing and processing of personal data
The online shop uses the personal data entered by the buyer (including name, phone number, address, and email address) only to process the order and send the goods to the buyer. The online shop transfers personal data to transport companies in order to deliver the goods.
The online shop will send newsletters and offers to the buyer’s email address only if the buyer has expressed a corresponding request by entering their email address on the website and announcing their wish to receive direct mail notifications. The buyer can cancel the offers and newsletters sent to their email at any time by notifying us by email or by following the instructions in the email containing the offers.
If the buyer has given consent to the marketing-related use of the data upon concluding a customer agreement or in any other way, Aurea Regina OÜ shall use such data under the terms and conditions and for the purpose specified in the General Terms and Conditions, including for sending direct personal marketing, campaign and discount offers to the buyers (for example, by email or SMS).
7. Settlement of disputes
If the buyer has any complaints regarding the online shop, these must be sent to the email address firstname.lastname@example.org or communicated by phone during the opening hours of the shop: (+372)-601-8088.
If the buyer and the seller are unable to resolve the dispute, the Customer has the right to contact the competent supervisory authority, which is the Estonian Consumer Protection and Technical Regulatory Authority, by sending an email to: email@example.com. The Consumer Disputes Committee is competent to settle such disputes arising from an agreement concluded between a consumer and a trader, which the parties are unable to resolve by agreement and if the value of the disputed goods or services is EUR 20 or more. The review of the complaint in the Committee is free of charge for the parties.
